The State Water Board has also amended the requirements of the UST California Regulation, Section 2716, to clarify the responsibilities of UST operators with respect to visual inspection by UST operators. This amendment requires the UST owner or operator to sign the designated operator`s corrective visual inspection within 72 hours of receipt and to confirm the inspection results in the Designated Underground Storage Tank Operator Visual Inspection. The State Water Resources Control Board (State Water Board) has amended the California Underground Storage Tank (UST) Regulations. These changes include both changes to the reporting obligations imposed by local authorities and changes to the reporting obligations applicable to UST owners and operators. The effective date of these amendments is October 1, 2020. The National Water Agency has significantly modified some of the forms in the regulations. The requirement for communication testing has been removed from the monitoring system certification form and the report form for secondary safety testing. Structural changes to the forms have been added to make it easier for UST owners, operators and local authorities to use and to be accessible to all users. In cases where the UST authorization is granted to a person other than the UST operator(s), the authorization holder must enter into a written agreement with the UST operator(s). This form can be used for this purpose. From Unidocs UN-106: “In cases, when the authorization for the underground storage tank (UST) is granted to a person other than the UST operator(s), the authorization holder must enter into a written agreement with the UST operator that requires the UST operator to monitor the UST(s), record appropriate data, implement reporting procedures and, on the other hand, in accordance with the conditions of the Unified Program Agency (UPA) Employment Directive. The use of this form to meet this requirement is optional.
